On February 5,
2016 the Czech Bar Association was authorized by the Ministry of Industry and
Trade of the Czech Republic for out-of-court resolution of consumer disputes
relating the disputes between lawyer and consumer arising from contracts on
provision of legal services (under the Act no. 634/1992 Coll., on Consumers
Protection, as amended). The website of the authorized entity is
www.cak.cz.
Under the Act
no. 634/1992 Coll., on Consumers Protection, the client/consumer is entitled to
file a proposal for its alternative resolution of a dispute to the Czech Bar
Association, not later than 1 year from the date when he exercised for the
first time its right, which is the subject of the dispute, at the law firm. The
proposal can be filed in Czech language on the attached form and sent to the
Czech Bar Association by Data Box, mail or email with an electronic signature.
The application must be accompanied by the statement which confirms that the
matter has not been resolved by a court, an arbitrational award has not been
given, the parties have not concluded any agreement within extrajudicial consumer
dispute resolution, as well as any proceedings
have been initiated.
In the event a
dispute between consumer and law firm has not been settled in direct way, the law
firm will provide the consumers with information related to extrajudicial
consumer disputes resolution according to this article in writing or on a
permanent data storage device.
